Every Dominican closing lives with a quiet fear: the gap. Between the day the parties sign and the day the transfer or mortgage is actually registered, the title remains in the seller’s or borrower’s name, and in a system where priority belongs to whoever registers first, that gap is exactly where a competing inscription, a surprise embargo or a second sale can land. Due diligence photographs the title at a moment; the gap is what happens after the photograph.
The certification with reserve of priority is the system’s answer, and it is one of the most underused instruments in Dominican real estate. Requested in connection with a specific intended operation, it does two things at once: certifies the property’s legal status and reserves priority for the announced operation during the certification’s term of validity. Anything filed against the property in the meantime ranks behind the protected operation. The buyer’s transfer, the lender’s mortgage, closes into the position the certification froze, not into whatever the gap produced.
The effect is transformative for transactional risk. Sellers cannot effectively double-sell into a reserved priority; creditors of the seller cannot leapfrog the protected buyer; the financing bank knows its mortgage will hold the rank it priced. It converts the most anxious stretch of a Dominican closing into a protected corridor.
The protection has boundaries, it is tied to the specified operation and lasts only for its legal term, so the closing calendar must be built around it, not despite it.
