The Provisional Note: How to Put the World on Notice Over Dominican Real Estate Property, Before It Is Too Late


Litigation is slow; property moves fast. Between the day a claim over Dominican real estate arises and the day a court resolves it, the property can be sold, mortgaged or encumbered, and in a registration system built on the protection of third parties who rely on the registry, whoever acquires in the meantime may take free of a claim they could not see.

The provisional annotation (anotación preventiva) is the law’s answer: a temporary entry on the registry that publicizes a pending claim, right or measure, so that no one who deals with the property afterward can claim ignorance. It does not decide anything; it preserves everything. If the claim ultimately succeeds, its effects run from the date of the annotation, not from the later judgment, which is often the whole game in priority disputes.

The catch is built into its name: provisional. Annotations are granted for limited terms and lapse if not renewed, which is why the procedure exists in dual form, annotation and renewal. A meritorious claim protected by an annotation that quietly expired is one of the more painful ways to lose a case outside a courtroom.

The framework is Law 108-05 and its regulations, which define the annotations available, their duration and renewal.
