Our attorneys evaluate and advise on independent contractor contracts and how they are executed in practice to mitigate the risks of potential application of Dominican labor laws, regulations and court precedents that may consider the existence of a labor relationship resulting from certain contractual provisions and practices.

Distinguishing between an employee and an independent contractor has important legal implications in the Dominican Republic, as Dominican labor laws and regulations apply to employees, but not independent contractors and a misclassification might result in the violation of labor laws and social security laws.
