The gavel falls, the price is paid, and the winning bidder at a Dominican judicial auction walks out with a court decision declaring the property theirs. It is a powerful document, and, until registered, an incomplete victory. In the Dominican Torrens-style system, real rights over registered property exist against third parties only once recorded. The adjudication procedure at the Title Registry is where the auction result becomes actual, opposable ownership.
Adjudication is the transfer that closes a real estate foreclosure (embargo inmobiliario): the court awards the seized property to the creditor or to the highest third-party bidder, and the resulting decision is filed with the Title Registrar, who cancels the debtor’s title, registers the adjudicatee as the new owner, and, critically, issues the new certificate.
The objective is twofold: to consummate the forced transfer and to clean the title, since adjudication generally extinguishes the registered charges that the foreclosure process purged, converting a distressed asset into a marketable one. That cleanup is precisely where technical precision pays: which inscriptions are cancelled, and which survive, must be resolved correctly at registration.
The framework combines Law 108-05 with the foreclosure regimes under which the auction ran, the Civil Procedure Code, Law 189-11 or Law 6186, each with its own registration nuances.
