A container of packaged goods can clear Dominican customs and still be unsellable. Without a sanitary registration, the registro sanitario, no packaged food or beverage may legally be imported, distributed or offered to the public, and retailers know it.

The Ministry of Health controls the sanitary lifecycle of foods, alcoholic and non-alcoholic beverages, beer, medicines, cosmetics, personal hygiene items and household cleaning products under General Health Law 42-01, from importation and export to evaluation, registration, advertising and promotion. Within the Ministry, the General Directorate of Drugs, Food and Sanitary Products (DIGEMAPS) sets the health requirements for producing and trading food and beverages, polices compliance, and runs the permit process itself.

What the application requires

For pre-packaged foods and beverages, the file starts with a formal application letter to the Health Minister identifying the applicant (trade name, legal representative with a copy of the Business Register where applicable, address, tax ID and contact details), the manufacturer and country of origin, and the product itself packaging characteristics with volume or weight, its quantitative and qualitative formula, and a description of the production flow.

The letter travels with supporting documents: a copy of the Trademark Registration Certificate, a copy of the Trade Name Certificate, three samples of the product as it will actually be sold (at least 200 grams each for solids, 250 milliliters for liquids or proof the samples were accepted by an authorized private laboratory), and labeling that complies with the NORDOM 53 directives, in Spanish or with a Spanish translation.

Products manufactured in the Dominican Republic additionally require a copy of the manufacturing facility’s own health permit. Imported products require two more pieces: a Certificate of Free Sale (or Certificate of Export) from the country of origin, and a power of attorney to the local legal representative or distributor. Both must be legalized by apostille or through the Ministry of Foreign Affairs, as applicable, and translated into Spanish by a certified legal interpreter.

Budget for sequence, not just fees

Government fees apply to each product registration, and each permit takes roughly three months from filing. The detail that surprises first-time importers is that registration is per product, each formula and presentation carries its own file, and that the trademark and trade name certificates come first. A portfolio of twelve SKUs is twelve registrations, and none of them can start until the intellectual property paperwork is done. Sequencing the two tracks in parallel is usually the difference between launching this season or the next.
