Before online marketplaces became routine in the Dominican Republic, launching one was news. On October 27, 2015, hundreds of guests gathered at the Dominican Fiesta Hotel & Casino in Santo Domingo for the press launch of Shopmundo.com, presented as the country’s first e-commerce platform, with Arthur & Castillo attorneys in attendance advising their client.

The platform’s premise was connection: a marketplace where buyers and sellers could reach each other in areas where access to the global market is difficult.

What a launch event does not show is the legal architecture underneath it. Putting a marketplace online in the Dominican Republic means addressing electronic commerce and digital signature rules, consumer protection obligations, data handling, payment arrangements and the intellectual property in the platform’s own brand and technology, work that happens months before the first press release.
