Trademarks in Dominican Republic: How the Nice Classification Decides What Your Registration Protects

Two companies can lawfully own the identical brand name in the Dominican Republic, one for software, one for rum, because a trademark registration protects a name only within the classes of goods and services it designates. Choosing those classes is not clerical work; it draws the boundary of your legal monopoly.

The Dominican Republic classifies trademarks under the Nice International Classification of Goods and Services, the system used by trademark offices worldwide. The country formalized its modern adoption through Resolution RD-116/2012 of August 9, 2012, which made the Nice Classification’s Tenth Edition mandatory for all applications filed from September 20, 2012, in its Spanish-language version.

The resolution reached backward as well as forward: renewal requests and amendments to registrations then in process, and those filed thereafter before ONAPI, had to be reclassified under the Tenth Edition’s changes. And it built in the future, providing that any new edition or adaptation of the Nice Classification would be evaluated and adopted through a subsequent resolution, which is why the edition in force today is a later one, updated as WIPO revises the system.

For a brand owner, the practical stakes are two. Under-designate, and your registration will not cover the products you actually sell, a gap competitors can exploit. Misclassify, and you face refiling costs and lost priority. Because each additional class carries its own fee, the exercise is a genuine strategy call: covering today’s product line, tomorrow’s extensions, and nothing you will never use.
