Updating a Mortgage Creditor’s Registration Certificate in the Dominican Republic: Why Lenders Should Not Hold Old Paper.


When a mortgage or other secured right is recorded at the Dominican Title Registry, the creditor receives its own official evidence of the registration, today, a certification of registration of creditors. But the format and content of that evidence have changed over the years as Law 108-05 and its regulations replaced older documents, and many lenders, banks, private mortgage holders, sellers who financed their own buyers, still hold paper issued under superseded formats or reflecting outdated data.

The update procedure exists to fix exactly that: it replaces the creditor’s prior document with a current certification reflecting the registered right as it stands today. The registered mortgage itself does not change; what changes is the creditor’s proof of it.

Why does that matter? Because the moment a creditor actually needs its certificate, to enforce, to assign the credit, to cancel the mortgage at payoff, or to prove rank against a competing creditor, an outdated document invites objections and delays at precisely the wrong time. For foreign lenders and heirs of deceased private creditors, the problem compounds: the file may be decades old and the supporting documents scattered.

The procedure is governed by Law 108-05 and the technical provisions of the National Directorate of Title Registries, which define the current form of creditor certifications.
