It is one of the most common, and most avoidable, obstacles in Dominican real estate closings: the seller is unquestionably the owner, but the identity document on the certificate of title no longer matches the one in their hand. A foreign buyer who acquired with a passport later obtained a Dominican cédula. A passport number changed with renewal. An old-series cédula was replaced decades ago. On paper, the registry now shows a person who no longer quite exists.
The identity document update procedure resolves the mismatch: it records the owner’s current identity document against the registered right, so that the person at the closing table and the person on the title are demonstrably the same.
The objective is continuity of identity, a quiet but essential piece of legal certainty in a Torrens-style system where the registry’s word is what counts. Left unattended, the mismatch surfaces at the worst moment: a sale ready to close, a mortgage ready to fund, an estate ready to settle, all waiting on a correction that could have been made years earlier.
The procedure is governed by Law 108-05 and the technical provisions of the registry administration. It is particularly relevant to foreign owners, who change passports every decade by definition.
